In October 2010, Steve Wu wrote a blog post about whether computer login and password information can itself be a trade secret. The post concerned the case entitled TMX Funding, Inc. v. Impero Technologies, Inc., No. C 10-00202 JF (PVT), 2010 U.S. Dist. LEXIS 60260 (N.D. Cal. Jun. 17, 2010) in the United States District Court for the Northern District of California.
In the TMX case, the Court held that the plaintiff acquiring company could assert a trade secret claim for trade secret misappropriation against employees who departed the acquired company. The plaintiff was able to proceed with its claim that the login and password information itself was a trade secret.
