Jeff Kobrick and Christopher Cooke Win Extraordinary Relief from California Court of Appeal

Cooke Kobrick & Wu LLP partners Christopher Cooke and Jeff Kobrick recently obtained from the California Court of Appeal in San Francisco the extraordinary appellate remedy of a “writ of supersedeas” staying all proceedings in the trial court during the firm’s appeal of the trial court's order denying a motion to compel arbitration.
In representing defendants in the Contra Costa Superior Court, Messrs. Cooke and Kobrick moved for an order compelling arbitration and a stay pending arbitration, but the trial court denied both requests. They then appealed the order denying arbitration and asked the trial court to stay the case during the appeal.
When the Superior Court denied that request, Messrs. Cooke and Kobrick filed a petition for a writ of supersedeas in the Court of Appeal asking for an order staying all proceedings in the Superior Court during the appeal on the issue of arbitration. Issuance of such an order by an appellate court is an extraordinary remedy and is rarely granted. However, on November 26, 2008, the Court of Appeal issued a writ of supersedeas staying all proceedings in the Superior Court pending the outcome of the appeal on arbitration. Jeff Kobrick Teaching Advocacy Skills Workshop at Stanford Law School

Cooke Kobrick & Wu LLP Partner Jeff Kobrick is teaching the Advocacy Skills Workshop to upper level law students at Stanford Law School during the Autumn 2008 term. Jeff is an experienced litigator and trial attorney, and has taught litigation skills to two generations of law students at Harvard Law School and Stanford Law School in simulation courses. Jeff also teaches Federal Pretrial Litigation at Stanford Law School in the Spring Term, which focuses on teaching students how to litigate a complex class action case in a federal court.
Stephen Wu Launches New Blog on eDiscovery, Digital Evidence and Cybersecurity

On October 8, 2008, Cooke Kobrick & Wu LLP Partner Stephen Wu launched a new blog called the “eDiscovery, Digital Evidence and Cybersecurity Law Blog” together with Attorneys Steven Teppler and Jon Stanley. All three lawyers practice in the areas of eDiscovery, digital evidence, and information security. On August 20, 2008, the SL Bar Association in the Second Life® virtual world announced that Cooke Kobrick & Wu LLP partner Stephen Wu was elected President-Elect of the association. He will become President in February 2009. Steve Wu became a member of the SLBA in 2007 and is also a member of the American Bar Association Section of Science and Technology Law’s Virtual Worlds and Multiuser Online Games Committee. On August 8, 2008, the American Bar Association Section of Science and Technology Law appointed Cooke Kobrick & Wu LLP partner Stephen Wu Vice Chair for the 2008-2009 bar year. Steve Wu served as Secretary of the Section for the 2007-2008 bar year, and before that served as a member of the Section’s governing Council from 2004 to 2007 and Co-Chair of the Section’s Information Security Committee from 2001 to 2004.
